General Terms and Conditions
BRUMAR Yacht Care
Article 1 – Definitions

BRUMAR Yacht Care: the company providing yacht care, cleaning, detailing, polishing, protection and related marine services.

Client / Customer: any natural or legal person entering into an agreement with BRUMAR Yacht Care.

Services: all services related to yacht care, detailing, cleaning, polishing, protection and related activities.

Products: all goods offered for sale via the BRUMAR Yacht Care website or webshop.
Article 2 – Applicability

These General Terms and Conditions apply to all offers, agreements, services and product sales of BRUMAR Yacht Care.

Deviations are only valid if agreed in writing.
Article 3 – Offers and Agreements

All offers are non-binding unless stated otherwise.

An agreement is concluded after written or digital confirmation by the Client.

Verbal agreements are only binding after written confirmation.
Article 4 – Execution of Services

BRUMAR Yacht Care shall perform its services to the best of its knowledge and ability.

Delivery times are indicative and never considered strict deadlines.

The Client shall ensure safe and unobstructed access to the vessel and provide correct information.
Article 5 – Obligations of the Client

The Client shall present the vessel in a condition that allows the services to be carried out safely.

Existing damage, wear or defects must be reported prior to commencement of the services.
Article 6 – Prices and Payment

All prices are exclusive of VAT, import duties, local taxes and shipping costs, unless stated otherwise.

Invoices for services must be paid within 14 days of the invoice date.

Online orders via the webshop require immediate payment using the available payment methods.

In the event of late payment, the Client shall be legally in default and statutory interest may be charged.
Article 7 – Sale of Products (Webshop)

These provisions apply to all product sales via the BRUMAR Yacht Care website.

Product images and descriptions are provided as accurately as possible but may differ from the actual product.

Delivery times are indicative and may vary per country.

The risk of loss or damage to products passes to the Client upon delivery.

Returns are only accepted if agreed in advance and in accordance with the return policy stated on the website.
Article 8 – Liability

BRUMAR Yacht Care is not liable for pre-existing damage, wear, ageing or material fatigue.

Any liability is limited to the invoice amount of the relevant service or product.

BRUMAR Yacht Care is not liable for indirect, consequential or business-related damages.
Article 9 – Risk and Insurance

All services are carried out at the Client’s risk.

The Client is responsible for maintaining adequate insurance coverage for the vessel.
Article 10 – Force Majeure

In the event of force majeure, BRUMAR Yacht Care is entitled to suspend or terminate the agreement without any obligation to pay compensation.
Article 11 – Cancellation and Complaints

Cancellation by the Client within 48 hours prior to commencement of the services may result in costs being charged.

Complaints must be submitted in writing within 7 days after completion of the services or delivery of products.
Article 12 – International Use

BRUMAR Yacht Care provides services and products to Clients worldwide.

The Client is solely responsible for compliance with local laws, import regulations, customs duties and taxes in their country.
Article 13 – Governing Law and Jurisdiction

All agreements shall be governed exclusively by Dutch law.

Any disputes shall be submitted exclusively to the competent court in the Netherlands.

These General Terms and Conditions are intended for use on the website, webshop and for international services and product sales.
Website Service Terms (Short Version)
Services
BRUMAR provides professional yacht cleaning, detailing, and maintenance services. The scope of work is agreed in advance with the Client.
Quotations & Pricing
All quotations are non-binding and valid for 14 days. Prices may vary based on vessel condition, location, and additional services.
Payment
Invoices must be paid within 7 days unless agreed otherwise. BRUMAR may request an advance payment.
Cancellation
Free cancellation up to 48 hours prior to the appointment. Cancellations within 48 hours may be charged at 50% of the agreed price.
Liability
BRUMAR is not liable for pre-existing damage, wear and tear, corrosion, oxidation, or structural defects.
Weather Conditions
Appointments may be rescheduled in case of extreme weather conditions to ensure safety and quality.
Access to the Vessel
The Client must ensure timely access to the vessel. Delays may result in additional charges.
Warranty
BRUMAR guarantees professional execution. No warranty applies to damage caused by improper maintenance after completion.
Privacy
Client data is treated confidentially and used solely for service delivery.
Governing Law
All services are governed by Dutch law.
